Emergency Medical Treatment and Labor Act Essentials: Avoiding Common Pitfalls

Most healthcare professionals understand the intent of the Emergency Medical Treatment and Labor Act (EMTALA), ensuring emergency care regardless of ability to pay. But understanding the spirit of the law isn't enough. EMTALA violations frequently occur in situations that have nothing to do with turning away indigent patients, catching well-intentioned clinicians, risk managers, and hospital leaders off guard.

Because EMTALA intersects with clinical judgment, hospital operations, and regulatory oversight, compliance can be complex. Violations can result from seemingly routine clinical decisions, transfer arrangements, and hospital policies that appear perfectly reasonable from a medical standpoint but run afoul of regulatory requirements.
